Messaging Terms and Conditions: You agree to receive informational messages (appointment reminders, account notifications, etc.) from Newbrough Piano Academy. Message frequency varies. Message and data rates may apply. For help, reply HELP or email us at welcome@newbroughpiano.com. You can opt out at any time by replying STOP.

1. About the program

Newbrough Piano Academy Inc. ("NPA," "we," "our") offers a text messaging program for enrolled families, prospective families, and supporters who have given express consent to receive messages from us. These terms govern that program and apply alongside our Privacy Policy.

2. How you consent

By providing your mobile number on an NPA enrollment form, registration form, website form, or event sign-up, or by texting us first at 585-540-2888, you agree to receive text messages from Newbrough Piano Academy at that number.

Consent is not a condition of enrollment, purchase, or participation in any NPA program. You can decline text messages and still enroll, attend, and receive everything else the school offers.

You confirm that you are the account holder or an authorized user of the mobile number you provide, and that you are 18 or older.

3. What we'll send you

Informational and transactional messages about the school, including:

  • Lesson reminders, confirmations, and schedule changes

  • Teacher absences, make-up lesson offers, and last-minute openings

  • Weather closures and building or parking notices

  • Account and billing notifications, such as invoice and payment reminders

  • Recital, event, and registration information

  • Occasional school news and announcements

4. Message frequency

Message frequency varies. Most families receive roughly 2–6 messages per month, though volume rises around recitals, registration periods, and weather closures.

5. Rates

Message and data rates may apply. NPA does not charge for this program, but your mobile carrier's standard messaging and data rates apply to messages you send and receive.

7. Opting out

Reply STOP to any message to cancel. You'll receive one confirmation message and no further texts.

You can also opt out by calling 585-540-2888 or emailing welcome@newbroughpiano.com.

Opting out has no effect on your student's enrollment or standing, and does not remove you from email communications — contact us directly to adjust those. To rejoin, reply START or sign up again through any NPA form.

8. Delivery and carriers

Supported carriers include AT&T, Verizon Wireless, T-Mobile, U.S. Cellular, Boost Mobile, Cricket, and others. Carriers are not liable for delayed or undelivered messages, and service may not be available on all carriers.

9. Privacy

Mobile numbers collected for this program are used solely for NPA communications. Mobile opt-in information will not be shared with third parties for marketing purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy for full details.

10. Changes to these terms

We may update these terms and will post the revised version here with a new effective date. Continued participation after an update constitutes acceptance of the revised terms.

15. Indemnification

You agree to defend, indemnify and hold harmless the Company, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Messaging Terms and Conditions.. 

16. Force Majeure

We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.

17. Governing Law and Jurisdiction

All matters relating to these Terms and Conditions and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of New York without giving effect to any choice or conflict of law provision or rule. Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of New York.

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

18. Successors and Assigns

This agreement shall inure to the benefit of and be binding upon the User and their respective heirs, legal personal representatives, successors and assigns.

19. Entire Agreement

The Terms and Conditions and our Privacy Policy constitute the sole and entire agreement between you and Company with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to our SMS use.

20. Waiver and Severability

No waiver by the Company of any term or condition set forth in these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.

If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms and Conditions will continue in full force and effect.
